HSB 577, the CO detector bill, was the subject of a second subcommittee meeting this morning.  It was also listed on the House Public Safety Committee agenda for 1 p.m.  Therefore, there was an assumption that the bill would be taken up in committee this afternoon.  That didn’t happen.  The amendment offered in subcommittee didn’t meet our concerns.  It didn’t require the tenants to either buy the detector or maintain it.  The exemption from liability proposal that we offered was objected to by the trial lawyers.  Consequently, the chair of the House Public Safety Committee decided that there was not enough consensus to run the bill this year.
 
That means there is only one bill left that we are focusing on.  Of course, we have to watch all amendments until the end of the session.  What’s left is HSB 693/SSB 3218, companion bills reacting to the War Eagle Supreme Court decision.  There was supposed to be a subcommittee meeting on the bill tonight, but it was rescheduled for in the morning.
 
Our landlord on the hill day is Tuesday of next week.  We have confirmations from several legislative speakers.  Senator Brad Zaun is a Republican Senator who serves on the Senate Judiciary Committee.  Rep Erik Helland is a Republican member of the House Judiciary Committee and is serving on the subcommittee on HSB 693.  Rep. Doug Struyk, who addressed us last year, will be back.  Rep. Struyk is a member of the House Judiciary Committee.  We also may have Rep. Geri Huser, also a member of the House Judiciary Committee.
 
Your timing of coming next week is perfect to begin major work lobbying on HSB 693/SSB 3218.

Day on the Hill Reminder

    We’re hopeful that some sprinkler bill will still be alive next Tuesday when you come to Des Moines.  Some have asked for more details about the day.  I did mention the guest speakers yesterday.
 
Time: 10:00 a.m.
 
Place: 6th floor cafeteria, Lucas State Office Building, 321 E. 12th St, Des Moines, directly east of the Capitol
 
We’ll hear from our guest speakers, talk about the legislative issues, have lunch at the Lucas Cafeteria, and then proceed to the legislature to do some lobbying.
 
BE SURE TO ADVISE YOUR REPRESENTATIVE AND SENATOR THAT YOU ARE COMING TO TOWN TUESDAY AND WOULD LIKE TO MEET WITH THEM.  ASK THEM WHAT WOULD BE A GOOD TIME IN THE LATE MORNING OR AFTERNOON TO VISIT WITH THEM.  YOU DON’T HAVE TO DO THIS, BUT IT IS HELPFUL IF THEY SCHEDULE A TIME TO VISIT WITH YOU.

Another Update

1.  There was a subcommittee meeting on HSB 693 today.  It’s expected to pass out of House Judiciary tomorrow.  HSB 693 is the Iowa Bar Association bill in response to the War Eagle case.  SSB 3218, the Senate companion to HSB 693 passed out of Senate Judiciary Committee today.
 
2. We’re expecting the House Public Safety Committee to pass out a sprinkler bill tomorrow.
 
3. The CO detector lobbyist are scrambling to salvage their bill, offering an amendment that would require residents to do the maintenance on the CO detectors that landlords will have to buy.  It’s uncertain whether the House Public Safety Committee will revive this issue tomorrow.  It is possible that it could be considered, even though it was pronounced dead yesterday.  These kinds of changes to happen at the legislature.  A bill can be dead one day, and get revived the next.
 
4. SF 2210 will be voted out of Senate Local Government Committee tomorrow.  A subcommittee meeting was held today.  The exact bill, dealing with how specified crime ordinances impact landlord/tenant laws, will likely be different from what you see in SF 2210.

Here is an update on the bills most of you are asking about.  Tomorrow is the beginning of week 5 of the legislature.  If a non-money bill isn’t out of one committee by Thursday night, the bill will be dead.  There is some chance, though small, that some of these items could appear as amendments to other bills on similar topics.

HF 2108 would overturn the state administrative rule requiring sprinklers in one/two family housing.  Would limit cities and counties from requiring sprinklers in one/two family houses and 4 plexes.

HSB 693 is the Iowa State Bar Association bill which is a response to the War Eagle Supreme Court case.  Landlord lobbyists have been working with the Iowa Bar on this draft.  Subcommittee members are as follows:  Rep. Eric Palmer (D-Oskaloosa), subcommittee chair;
Rep. Tyler Olson (D-Cedar Rapids), and Rep. Eric Helland (R-Grimes).   Landlords of Iowa, Iowa Landlords Association, and the Iowa Manufactured Housing Association support HSB 693.  HSB 693 may not be everything you ever dreamed of as reform, but the bill has to meet the constitutional standards outlined in the War Eagle decision.
